RULE PROCEDURE

  • All Motions to Compel must be accompanied by a certificate that counsel have conferred to amicably resolve the dispute, in accordance with the Uniform District Court Rules.
  • All opposition memos to contradictory motions must be filed 8 days prior to the time of the hearing and must be delivered to the Judge's Law Clerk. Failure to comply means forfeiture of the right to oral argument.

TRIAL PROCEDURE

  • When a case is ready to be set for trial, the proper procedure is to file a Motion to Set for Trial on the Merits on a Form 85.  The Court will assign a date for a pre-trial conference and mail notice to the parties. Pre-Trial conferences must be attended in person and cannot be conducted by telephone, unless the parties are from out of town.
  • Prior to the morning of trial, all parties must comply with this Court's Trial Order and deliver to the Judge's Law Clerk joint jury charges and interrogatories.
  • For Judge trials, parties must submit to the Court on the morning of trial proposed judgments and proposed findings of fact. Plaintiffs must submit a list of special damages one week prior to trial.
  • When a case is continued, you should receive a new trial order that verifies the new trial date and any new cut-off dates. If you do not receive this within one month after your trial has been continued, please contact the division law clerk.
  • If you desire to set a status conference with the Judge to discuss problems with the case or possible settlement, there is not need to file a motion. Please call the Judge’s chamber and someone will assist you in scheduling a status conference on the Judge’s calendar. If you want to set the case for trial and pick cut-off dates, please file a form 85 and a pre-trial will be set.

OTHER

  • Any Motions to Withdraw must be accompanied by the last known address of the client and a copy of a certified letter notifying the client of the intent to withdraw.
