RULES
Rules are scheduled for
9:00 AM on alternating Fridays - call the Division for confirmation of a
date.
Trials are generally scheduled for 9:00 AM Monday - Thursday.
TRIALS
A motion to set for trial may be filed
by either party after all issues have been joined and preliminary
matters have been disposed of. Motions to set for trial must state the
length of time the trial is expected to last, and whether it is a bench
or a jury trial.
Once a trial date is set by the court,
deadlines and cut-off dates are issued.
See Division "I" Trial Order.
For jury trials, the parties
shall submit joint jury instructions and joint jury interrogatories (on
diskette) to the court seven calendar days prior to trial.
For bench trials, all parties
are required to submit a Quantum Study 48 hours in advance of the trial
date. Parties shall also submit proposed judgments and proposed findings
of fact on the morning of the trial.
Plaintiffs shall submit a list
of special damages one week prior to trial.
CONFERENCES
It is NOT necessary to schedule a
Status Conference for the purpose of setting a trial date and deadlines.
However, if it is thought that the judge can assist in moving the case
along, any party may call to schedule a status conference or a
settlement conference.
Pre-trial conferences are held the
morning of trial.
MOTIONS
Motions to continue filed by a party
other than the mover must indicate if the mover has been notified and if
there is any opposition to the continuance.
All opposition memos must be filed 8
days prior to the hearing, pursuant to the "Rules for Louisiana District
Courts". Failure to comply may result in the denial of the right to oral
argument.
Motions to withdraw must contain the
last known address of the client and assertion that the client has been
informed of the intent to withdraw, as well as the date of any pending
hearings. See "New Uniform District Court Rules", 9.13. Notice must be
given to the client at least 10 days before filing the motion.
Motions to Compel must have a Rule
10.1
certificate attached. A rule date will not be set if there is no
certificate.
Motions for summary judgment must be
disposed of at least 10 days prior to the trial date.
JUDGMENTS
Judgments are to be submitted within 7
days of the hearing. The person preparing the judgment should present a
copy to the opposing party prior to submission to the Judge.
Consent Judgments are to be submitted
within 14 days of the hearing.
